Preparing for a Wrongful Death Case
Under Florida law on wrongful death cases, the “Personal Representative” for the decedent’s estate will file the lawsuit. However, this person is representing the estate’s heirs, and these interested parties will be named in the suit. Surviving spouses, minor children, adult children if there is no surviving spouse, and parents if the decent had no spouse or children, may all collect damages in a wrongful death. Damages may be for both financial losses, including lost earnings and potential future earnings, and emotional losses, like loss of companionship.
Florida law requires the following in a wrongful death suit:
- The defendant’s conduct amounted to a wrongful act, negligence, default, or breach of contract or warranty;
- The conduct upon which the cause of action is based must have caused the death of the decedent; and
- Such conduct must have entitled the person injured to maintain an action and recover damages if death had not ensued.
