Some of the most tragic personal injury cases our lawyers and paralegals have resolved for the families of our clients sadly involve catastrophic injuries or death related to commercial trucking crashes and accidents on roadways, especially on I-95.

If you’ve been injured in an auto accident involving a commercial truck, or if you’ve lost a loved one in a similar accident, then you know there’s almost nothing we can say on this page to console you. The truth is, we cannot bring back the life of a loved one. If you survived a horrific crash, we cannot guarantee that you will return to the same quality of life you had before the accident.

What we can promise you is this:

  • We are going to vigorously fight for every penny in compensation you deserve.
  • We are going to identify every possible avenue of compensation, and no matter how unlikely.
  • We will never back down form the insurance companies.
  • We will also remain compassionate, patient, and understanding with you.
  • You, as our client, are our number one priority and focus.

Do not settle on just any law firm to handle your important trucking accident claim. Just because your family friend or distant relative is a lawyer does not mean they are qualified to handle such an important and complex case.

Instead, you need to hire a law firm with a proven track record of securing excellent results and victories for clients who were injured or killed in serious trucking accidents, like our firm.

Trucking accidents involve complex issues such as the interplay between federal and state laws, complex national standards for commercial truck drivers, and the use of expert witnesses.

How Trucking Accidents Happen in Florida

Commercial trucking accidents take place frequently in the state of Florida. According to the Florida Department of Highway Safety and Motor Vehicles, there are approximately 2,500 accidents involving commercial vehicles in Florida each month, that result in around 10,000 injuries and roughly 200 fatalities. These cases are extremely serious, requiring the complete attention and dedication of an experienced personal injury attorney.

At some point in time, almost all drivers will be sharing the road with some type of large commercial vehicle. Due to the weight and size of these trucks, what might seem like minor collisions can result in significant injury or even death. Smaller vehicles’ drivers are particularly vulnerable in these circumstances, where being involved in a trucking accident could result in injuries that may have lifelong effects.

Commercial trucking and transport accidents often occur due to:

  • Vehicles Over Tow Limit
  • Unsecure Materials and Debris
  • Vehicles Not Maintained
  • Unbalanced Cargo
  • Over worked or Tired Drivers
  • Breaking Traffic Laws
  • Tired Driving
  • Distracted Driving
  • Lack of Visibility
  • Reckless Driving
  • Drunk Driving
  • Drug Impaired Driving

Our team of trucking accident personal injury lawyers at the Law Offices of Craig Goldenfarb, P.A. understand your legal rights and are not only committed to getting you the maximum amount of compensation possible, but helping you through the physical recovery process.

Trucking Accident Liability & Damage Recovery

Anyone who operates a motor vehicle is responsible for driving safely, so that they don’t put others on the road in harm’s way. This is an especially important responsibility for anyone who drives commercial trucks, as these vehicles are disproportionately large and heavy compared to other vehicles on the road. If that duty is ignored, other drivers and passengers may be hurt or killed due to the negligent conduct of another.

The driver at fault is then liable for bodily injury, pain and suffering, and any vehicle damage that takes place as a result of their negligence. In commercial accidents, the company that employs the driver at fault may also be liable, especially if they failed to properly screen their employees for poor conduct, drug use, or other issues that may lead to accidents.
If you have been hurt in a commercial trucking accident, the Law Offices of Craig Goldenfarb, P.A. may be able to help you get the compensation that you are entitled to. Motor vehicle accident personal injury compensation may include:

  • Hospital & Medical Bills
  • Lost Wages
  • Pain and Suffering
  • Cost of Future Care

Core Values

7 Steps To Take
Following a Car Accident

Step 1: Stay on the Scene

Leaving the scene of an accident you are involved in, especially if some has been injured or even killed, is a criminal offense. Doing so could result in significant criminal charges and even jail time.

It is always best to wait for the appropriate time to leave, which will be indicated by a present law enforcement officer.

Step 2: Check on Everyone

First make sure that you are OK, and that you have not sustained any injuries. Some of your own injuries may not be immediately apparent, so be cautious before rushing to the aid of another.

If anyone on the scene needs emergency medical attention, contact an ambulance immediately.

If anyone is unconscious or in severe pain, do not move them unless they are in eminent danger, otherwise wait until qualified medical professionals arrive.

Step 3: Call the Police

The police deal with auto accidents frequently. Having a law enforcement authority on the scene will allow you to have an official police report filed detailing the occurrence, and ensure that the appropriate information has been exchanged.

Do not move your vehicles so that when the police arrive, the scene can be reported as accurately as possible.

Step 4: Gather Evidence

It is important to be as prepared as possible even in situations that seem less significant.

Don’t simply rely on the police report, but gather all the information necessary from drivers, which will include:

  • Full Name
  • Phone Number
  • Address
  • Drivers’ License Number
  • Vehicle Registration Information
  • License Plate Number
  • Insurance Information
  • Take Pictures!

If there are any passengers or witness, collect their names, phone numbers and addresses also. Makes sure to take pictures, and if possible draw a small diagram of the accident.

Take pictures of the accident site and of any damages to your vehicle as soon as possible, this helps ensure that you receive the appropriate amount of compensation for vehicle damage and help you recall details that might otherwise later escape your memory.

Step 5: Contact a Lawyer

A major car accident is one of the most terrifying and stressful events that may occur in a person’s life. Besides having to deal with the pain of your injuries, there are other considerations, such as the damage to your vehicle and working with the insurance company that can become a headache for you to experience.

Contact an experienced attorney like the Law Offices of Craig Goldenfarb, P.A. to represent you if you suffer a personal injury in an auto accident. A skilled attorney will be dedicated to serving your interests and can assist you in recovering financial compensation and additional aid for future expenses resulting from your injury.

Step 6: Get Medical Treatment

Sometimes due to the rush of adrenaline as a consequence of the car accident, your injuries may not be immediately apparent, as you may have sustained internal injuries that reveal themselves several days after the auto accident.

Make sure to see a doctor as soon as possible, even if you don’t have insurance, and keep a detailed account of medical expenses which could bolster your case. You may be entitled to compensation for such expenses.

Our attorney team at Law Offices of Craig Goldenfarb, P.A. will actually guide you through this process, so that you get the appropriate treatment for your needs.

Step 7: Be Extra Cautious!

DO NOT admit fault or claim liability to anyone on the accident scene.

DO examine your surroundings, be vigilant or additional dangers, and document the scene to the best of your ability.

DO NOT call a “lawyer referral service” for help;

DO hire a lawyer who can refer you to medical treatment within 14 days of the accident.

DO NOT allow anyone to solicit you after an accident, either by phone or in person, to either hire an attorney or visit a clinic;

DO report the incident to the Division of Insurance Fraud at 1-800-378-0445. You may be entitled to a reward for the successful prosecution of solicitor crimes.

DO NOT sign anything you are uncomfortable signing nor agree to an insurance settlement prematurely;

DO ask any lawyer you are considering to hire for a free consultation.
