  • Stuart Motocyclist Leonard David Sclafani Killed in Multi-Vehicle Crash in Stuart

    According to Florida Highway Patrol, both riders were thrown clear of the motorcycle and into the street by the impact.

    Sadly, a third vehicle heading south struck the motorcycle’s driver, 63-year-old Leonard David Sclafani of Stuart, who was later pronounced dead at the scene. His passenger, who has not been identified, was taken to a hospital and listed in critical condition. The drivers of the two other vehicles involved were not injured, and FHP says the cause of the crash is under investigation.

    If there was negligence on the part of one of the drivers or the auto manufacturer, Sclafani’s family may have grounds to move forward with a civil Wrongful Death case.

  • Riviera Beach Resident Jorge Alejandro Ruiz-Gandara Killed in Motorcycle Accident Near West Palm Beach

    The motorcycle rider, 23-year-old Jorge Alejandro Ruiz-Gandara of Riviera Beach, was driving northbound on Military Trail near West Palm Beach. The four-door Toyota, driven by an 82-year-old driver, was also heading northbound in a separate lane. The Sheriff’s Office says the Toyota driver attempted to turn right and go south instead. However, the Toyota traveled eastbound into the northbound lanes and the path of the Suzuki motorcycle. Ruiz-Gandera was wearing a helmet, and was taken to a local hospital, where he was later pronounced dead. The Toyota driver was unhurt, and the report says charges are pending.

  • Stuart Resident Robin New Dead After Tragic Hang Gliding Accident

    “It’s a shame, I don’t know all of the details of what happened, but he (New) was very safe and he was very educated (about hang gliding) and had all of the certifications,” Greenstein said.

    On Saturday afternoon, Martin County Fire Rescue received a call around 1:30 PM requesting help with a “traumatic incident” near the Jensen Causeway. Florida Wildlife Commission (FWC) officials described the incident as a tragic malfunction: “While launching the hang glider from the vessel, a malfunction occurred and the hang glider nose-dived into the water resulting in a fatality.”

    Miami Beach Civilian Ivonne Reyes Killed After Police Car Chasing Stolen BMW Causes Car Crash

    On Monday evening, March 25, a Miami Beach police chase ended with a woman dead and a police officer injured.

    Miami Beach spokesman Ernesto Rodriguez says the Miami Beach police officer was chasing a stolen BMW late Monday evening. The patrol vehicle crashed into a Honda that was not involved in the chase, shearing off its hood. The crash left the officer with a serious head injury. The other driver, 68-year-old Ivonne Reyes of Miami Beach, was taken to a local hospital, where she later died.

    Other officers followed the BMW, which later crashed into two patrol cars. The driver fled on foot, and another police officer was taken to the hospital, treated, and released.  The following day, 35-year-old Timothy Bowers was arrested for the BMW theft, and several additional charges, including murder, and aggravated assault on a law enforcement officer.

    School Teachers Electrocuted at Miami High School, Son Injured

    On March 10, Liberty County High School’s head baseball coach, 39-year-old Corey Crum, and his wife, 41-year-old Shana Crum, died following a tragic electrocution accident at the baseball field. Their 14-year-old son was also injured, but is expected to recover.

    A press release sent out by Liberty County Sheriff Joe White explains that Coach Crum was using a boom lift to remove a piece of equipment from a trailer when the incident occurred. The lift’s boom made contact with power lines, electrifying the boom lift and electrocuting Coach Crum. Crum’s wife and son attempted to help him and were also electrocuted. Both adults were pronounced dead at the scene by Liberty County EMS. Their son was taken to a hospital for treatment.

    The Crums and other parents and students were replacing a scoreboard that had been destroyed by Hurricane Michael when the tragedy happened. Coach Crum was in his first year as head varsity baseball coach, and Shana Crum worked as a health aide at the school. Coach Crum’s brother, Randall Crum, spoke with the team and told them his brother would have wanted them to keep pressing forward and do their best. The school board is providing grief counselors for students and parents affected by the tragedy.

    Student Pilot Killed Following Plane Crash in Indian River

    Authorities say a plane crash in Indian River County on Tuesday morning led to the tragic death of a student pilot.

    The Indian River County Sheriff’s Office received a call about the crash around 11:30 AM on Tuesday, March 5. It was reported that the plane disappeared shortly after takeoff. Authorities searched for the plane, and a Sheriff’s Office chopper located it in a wooded around 1:30 PM.  The Florida Forest Service then had to dig a pathway to reach the remote crash site.

    The plane, a Piper PA-28, had taken off from Vero Beach Regional Airport, bound for Palm Beach County Glades Airport in Pahokee, according to FAA records. The pilot was not immediately identified. However, Steve Phillips, the Vice President of Communications at FlightSchool Academy in Vero Beach, confirmed the pilot was one of their students.

    Authorities have not yet determined how the plane crash occurred, but the FAA and the National Transportation Safety Board (NTSB) are investigating the crash.

  • Family of Jupiter Woman Abbie Rosemeyer May Have a Legal Case

    Abbie Rosemeyer, a Jupiter resident, died Monday, January 21st at 8:30pm in a car crash east of Belle Glade. According to Florida Highway Patrol, Rosemeyer was traveling west on State Road 80 west of Twenty Mile Bend, when an eastbound semi tractor-trailer attempted a left turn onto an access road roughly 4 miles west of Country Road 880. The 2015 Ford Fusion that Rosemeyers was driving at the time, collided with the truck which was driven by 57-year old Miami resident Jose A. Alonso. By the time the rescuers arrived, Rosemeyer had already passed away.

    Rosemeyer was a distinguished community volunteer and her legacy will leave a lasting impression in Palm Beach County and the Treasure Coast. She was a board member for the nonprofit Families First of Palm Beach County and the director of business development at SandyPines Residential Treatment Center in Tequesta, which serves children and adolescents.
    Even though no criminal charges have been filed, the Florida Highway Patrol is still investigating who is at fault for the incident. If Mr. Alonso is found to be responsible, the family of Abbie Rosemeyer will likely have grounds for moving forward with a civil Wrongful Death case.   • John McCasey’s Family May Be Entitled to Compensation for Wrongful Death Case

    A 72-year-old man died after a collision he had with a car while driving a golf cart in Palm Beach Gardens. John McCasey, a Jupiter resident, was thrown from the golf cart as he drove into the crosswalk at Donald Ross Road and Pasteur Boulevard after being hit by a 2017 Honda CRV. According to the Palm Beach County Sheriff’s Office (PBSO), the accident occurred at 12:30pm on December 29th 2018 where the significant injuries McCasey sustained required he be taken to St. Mary’s Medical Center. He died at 2:30pm later that day as a result.

    The driver of the CRV, Stephen Potts, 64 of The Villages was not injured during the collision and it does not appear that he will face any criminal charges in connection to the crash according police records. It may be the case that Potts was at fault and if confirmed as such, the family of the now deceased John McCasey will possibly have a valid case against Stephen Potts for the Wrongful Death.   • Family of Irma Fensterman May Be Entitled to a Wrongful Death Lawsuit

    An elderly driver named Irma Fensterman died on Sunday, January 6th from injuries she sustained in a car accident she was involved in only 10 days earlier. The 88-year-old was driving her 2018 Honda Accord at 9am December 27th going north on Bryan Blvd toward Linton Blvd. Authorities from the Palm Beach County Sheriff’s Office (PBSO) claim that as she was driving across the intersection, another driver identified as Nicole Perez collided with the driver’s side door, in a 2016 Nissan Rogue, as she was heading east on Linton.

    According to the report, both drivers claimed that they had a green light and though both were wearing their safety belts, Fensterman was immediately taken to Delray Medical Center where she died the following Sunday. Perez managed to walk away with minor injuries, but her father, when addressing the incident stated that ‘she may never be the same”, in reference to the distressing nature of the circumstance.

    Though PBSO records indicate that they will not be pursuing criminal charges in this case, if Perez is found to be at fault, the family of the deceased may have a legitimate legal case for a Wrongful Death.   • Caleb Ray, 8 Year-Old Boy, Dies Due to SCA on Soccer Field

    [vc_row][vc_column][vc_column_text]A West Virginia family is grieving the loss of their previous 8 year-old boy, Caleb Ray, after he suddenly collapsed on a soccer field in Lincoln County. The father was there by his side within seconds, and CPR was administered while the ambulance rushed to the scene. Unfortunately, Caleb could not be saved. The family has been quoted as believing that the cause of death was Sudden Cardiac Arrest (SCA).

    The boy’s surviving parents describe the scene of the incident as being on a soccer field. Young Caleb was just starting the first practice session of his soccer season. Though the details have not been released, it appears that he had joined a little league team, and may have been on the premises owned either by the city, or a youth athletic organization.

    It also appears there was no Automated External Defibrillator (or “AED”) present. These life-saving devices counter-act sudden cardiac arrest by delivering a shock to the heart that normalizes heart rhythms.

    Why there may be a potential liability case

    There maybe a potential liability case against the owner(s) of the field that the incident occurred on for not having an AED present. West Virginia state laws dictate how and when AEDs should be present and used. A theory of liability may lie in the statute.

    West Virgina does have a Good Samaritan law, but that may only apply in situations in which an AED is used. Further, it is unclear on first reading of WV laws what facilities or organizations may by required to have an AED on site. If an AED was required, and one was not present when Caleb experienced SCA, the owners and/or managers of the property on which the incident occurred may be held liability.

    The family is doing the right thing

    The surviving parents are doing the right thing by advocating for the widespread adoption of AEDs. With an AED present, the chances for survival for a victim of SCA tops 90% when used within three minutes of the onset of the sudden attack.

    The family has received donations to help buy AEDs to be present at youth sports games.
