  • Police Officer Struck by Car While Chasing Suspect May Have a Legal Case

    [vc_row][vc_column][vc_column_text]Boynton Beach Police Chief Michael Gregory says an incident where an officer was struck by a car is another example of how dangerous police work is.

    On February 27, Officer Greg Wertman, 34, and other officers were called to the Kohl’s store at 1901 N. Congress Avenue. The store reported two people were spotted shoplifting about $1,200 in baby items. When officers arrived, one of the suspects took off. Wertman pursued him, running between cars in an effort to catch the suspect.

    Sadly, one driver didn’t see Wertman in time and her SUV struck him as he chased the suspect. Chief Gregory says she is unlikely to be charged.

    Wertman was rushed to the hospital, where he remains in serious condition. The suspect he was chasing was apprehended by other officers and arrested.

    Federal Agencies Investigate Fatal Crash Between Tesla and Semitrailer

    [vc_row][vc_column][vc_column_text]On Friday, March 1, a crash involving a Tesla and a semitrailer led to the tragic death of the Tesla driver, 50-year-old Jeremy Banner of Lake Worth. The National Transportation Safety Board (NTSB) announced on Monday, March 4, that they a three-person team would conduct a safety investigation. An NTSB spokesperson said the team had already visited the crash scene, and the National Highway Traffic Safety Administration is also investigating the crash.

    Although the NTSB did not give specifics of their investigation, the crash is similar to one that occurred near Gainesville in May of 2016. In that incident, the driver of a Tesla Model S died when his vehicle went under a semitrailer and its roof was sheared off. After investigating that crash, the NTSB found design limitations in the Tesla’s autopilot system contributed to the accident.

    The Palm Beach County Sheriff’s Office accident report for last week’s crash doesn’t specify whether the Tesla’s autopilot feature was in use at the time of the accident. Tesla has said previously that while its autopilot and emergency braking features are meant to help motorists, drivers should still keep watch the road and be prepared to take control.

    Jeremy Banner died at the scene of the accident, and the semitrailer driver was unhurt.

    If there was negligence on the part of the semitrailer driver or the auto manufacturer, Banner’s family may have grounds to move forward with a civil Wrongful Death case.   • Family of Jupiter Woman Abbie Rosemeyer May Have a Legal Case

    Abbie Rosemeyer, a Jupiter resident, died Monday, January 21st at 8:30pm in a car crash east of Belle Glade. According to Florida Highway Patrol, Rosemeyer was traveling west on State Road 80 west of Twenty Mile Bend, when an eastbound semi tractor-trailer attempted a left turn onto an access road roughly 4 miles west of Country Road 880. The 2015 Ford Fusion that Rosemeyers was driving at the time, collided with the truck which was driven by 57-year old Miami resident Jose A. Alonso. By the time the rescuers arrived, Rosemeyer had already passed away.

    Rosemeyer was a distinguished community volunteer and her legacy will leave a lasting impression in Palm Beach County and the Treasure Coast. She was a board member for the nonprofit Families First of Palm Beach County and the director of business development at SandyPines Residential Treatment Center in Tequesta, which serves children and adolescents.
    Even though no criminal charges have been filed, the Florida Highway Patrol is still investigating who is at fault for the incident. If Mr. Alonso is found to be responsible, the family of Abbie Rosemeyer will likely have grounds for moving forward with a civil Wrongful Death case.   • John McCasey’s Family May Be Entitled to Compensation for Wrongful Death Case

    A 72-year-old man died after a collision he had with a car while driving a golf cart in Palm Beach Gardens. John McCasey, a Jupiter resident, was thrown from the golf cart as he drove into the crosswalk at Donald Ross Road and Pasteur Boulevard after being hit by a 2017 Honda CRV. According to the Palm Beach County Sheriff’s Office (PBSO), the accident occurred at 12:30pm on December 29th 2018 where the significant injuries McCasey sustained required he be taken to St. Mary’s Medical Center. He died at 2:30pm later that day as a result.

    The driver of the CRV, Stephen Potts, 64 of The Villages was not injured during the collision and it does not appear that he will face any criminal charges in connection to the crash according police records. It may be the case that Potts was at fault and if confirmed as such, the family of the now deceased John McCasey will possibly have a valid case against Stephen Potts for the Wrongful Death.   • Family of Irma Fensterman May Be Entitled to a Wrongful Death Lawsuit

    An elderly driver named Irma Fensterman died on Sunday, January 6th from injuries she sustained in a car accident she was involved in only 10 days earlier. The 88-year-old was driving her 2018 Honda Accord at 9am December 27th going north on Bryan Blvd toward Linton Blvd. Authorities from the Palm Beach County Sheriff’s Office (PBSO) claim that as she was driving across the intersection, another driver identified as Nicole Perez collided with the driver’s side door, in a 2016 Nissan Rogue, as she was heading east on Linton.

    According to the report, both drivers claimed that they had a green light and though both were wearing their safety belts, Fensterman was immediately taken to Delray Medical Center where she died the following Sunday. Perez managed to walk away with minor injuries, but her father, when addressing the incident stated that ‘she may never be the same”, in reference to the distressing nature of the circumstance.

    Though PBSO records indicate that they will not be pursuing criminal charges in this case, if Perez is found to be at fault, the family of the deceased may have a legitimate legal case for a Wrongful Death.   • What Not to Do After a Car Accident

    According to the latest data available from the National Highway Traffic Safety Administration (NHTSA), in 2015, there were 6,264,000 non-fatal crashes in the United States – that’s 3.8% more crashes than the year before.

    • Don’t agree not to call the police; you need the police. Not only do they write up a police report (which is valuable), the police prevent the other driver from providing you with false information (which happens). If the police ticket the other driver for breaking a traffic law, it will make your case that much easier to prove.
    • Don’t sign a Medical Release for the other driver’s insurance company. This allows them to dig into your medical history and try to find a way to blame your new injuries on an old medical condition. Even if an old condition is aggravated by the accident, the insurance company has no right to use it to diminish your claim – but that doesn’t stop insurance companies from trying!

  • Why All of Our Clients Should be Concerned About PIP Fraud

    South Florida is a wonderful place to live. However, we are not without our fair share of criminals looking to take advantage of residents. One serious illegal activity that continues to affect our clients directly is PIP fraud. “PIP fraud” is a term law enforcement uses to categorize crimes against Florida’s auto insurance laws.

    Personal injury protection insurance, or PIP, pays for your medical treatment following an auto accident, regardless of who is at fault for the crash. PIP fraud generally relies on insurers paying fake or false medical claims under PIP law.

    A typical scheme works like this: You get into a bad enough accident that the police are called, or your car is inoperable and towed. Your personal information is obtained by someone called a “runner” who contacts you and offers to help you get treatment. If you tell them you’re not injured, the caller may entice you with a cash payment to visit a specific clinic or medical center anyway, with the promise of more when the “case” is over.

    The medical clinic then employs a crooked personal injury lawyer to file a claim against your insurance company for the PIP dollars. Because the state minimum of required PIP insurance is $10,000, that’s often the limit to how much the lawyer is willing to obtain. Everyone gets paid with the PIP money – the runner, the doctors, and the lawyer – and you as the victim are offered very little, if any, from the funds.

    The sad truth of this illegal scheme is that these criminals are basically stealing your PIP insurance proceeds from you, and keeping it for themselves. So what part of this is illegal, exactly? For one, contacting an auto accident victim in any way (by phone, text, email, or in person) to solicit them for medical treatment or legal representation is illegal in the state of Florida.

    Another crime occurs when the “runner” tries to bribe you, the victim, with a cash payment for going to their clinic of choice. While all these crimes are serious offenses, it’s the insurance fraud scheme that you should be most concerned about. By falsifying or exaggerating injuries and treatment related to an auto accident, these people are committing felonies.

    Depending on the scope and size of the criminal ring, these financial crimes are punishable by several decades in prison, and millions of dollars in restitution and legal fines. How does this affect you, the auto accident victim?

  • Injury Suit Filed Against Man Who Attacked Uber Driver

    If you’re an avid user of social media, chances are good that you’ve seen the video of a man violently attacking an Uber driver last Friday. In the video, which quickly went viral, you can clearly see a man named Benjamin G. attack the driver, hitting him multiple times before grabbing his hair and attempting to slam his head into the dash and steering wheel.   • Understanding Insurance Requirements in Florida

    If you’ve registered a vehicle in Florida, you’re required to obtain insurance coverage. Florida, like most other states, has set a minimum amount of insurance which all drivers are required to carry. This minimum coverage is at least $10,000 worth of property damage liability insurance, and another $10,000 in personal injury protection.

    Minimum Coverage

    Personal Injury Protection (PIP) Insurance

    Florida is a “no-fault” auto insurance state, meaning your insurance company will be responsible for compensating you in the event of a crash no matter who was at fault. Personal injury protection insurance covers you in your own vehicle, as well as other vehicles you may be a passenger in. This insurance will also cover you if you are involved in a pedestrian accident or bicycle accident. Additionally, PIP insurance will cover your children, other members of your household, and any passengers who do not have PIP insurance, provided they also do not own a car. The amount you can recover in an insurance claim is capped by the limits of your policy.

    Minimum: $10,000 PIP coverage in the state of Florida
    Property Damage Liability (PDL) Insurance

    While personal injury protection covers bodily harm and injuries, PDL coverage covers damages to other people’s property. The most common example of this is damage to the vehicle, but can also include things like walls, fences, or even valuable stored inside the car at the time of the crash.

    Optional Coverage: Bodily Injury Liability (BIL) Insurance

    In addition to PIP insurance, which covers injuries to you and specific passengers, and PDL, which covers damage to other peoples’ property, there is also BIL coverage. Essentially, this coverage gives you financial defense in case you are sued by an injured person, but many insurers also provide legal representation if this happens.

    What if I Don’t Have Insurance?

    If you’re driving without insurance, the best case scenario is a license suspension of up to 3 years and fees which can total $500.
