Injured In A Train Collision? We Can Help.

We’ve helped thousands of injury victims recover from serious collisions.

Nothing can prepare you or your family for the injury or loss of a loved one due to a train collision or crash with a pedestrian or vehicle that is occupied. The decimation of life and limb is nothing short of a horrific nightmare.

In the days and weeks following such a tragedy, depression and fear can cripple the surviving loved ones. But you know you have to be brave and strong for those you have lost. And that means making good decisions about your financial future and wellbeing. Our law firm exists to support you in this dire time of need.

Railroad injuries and accident claims are very difficult cases to pursue against defendant railroad companies, their insurance carriers, and their employees and operators. Commuter rail operators like Brightline [link to something about Brightline, like a blog post] use a handful of go-to excuses for denying blame or delaying compensation claims, but the good news for you is that you found the law firm that knows how to get around these common tactics.

We have handled several high-profile railroad and train accident cases involving commercial freight trains and commuter rails, and we have successfully obtained millions of dollars’ worth of compensation for our clients because we have the experience, expertise, and tenacity to aggressively pursue these difficult claims.

The duty of railroad companies to keep their tracks clear

Railway and other transportation companies have a duty to provide safe travel for their passengers, as well as their employees. Unfortunately, this doesn’t always happen. 878 people died in train accidents in the US in 2018. 270 of those were highway-railroad crossing collisions involving a train and another vehicle.
More than 2,500 train accidents occur each year in the US, according to the Department of Transportation and the Federal Railroad Administration.
Common causes of train accidents include:

  • Conductor Error
  • Railway Negligence
  • Inspection or Maintenance Violations
  • Loose Cargo
  • Negligent Motor Vehicle Operator
  • Stalled Vehicle Sitting on Tracks
  • Mechanical Failure
  • Distracted Pedestrian
  • Emergency Braking
  • Fault Crossing Lights or Dividers
  • Track Obstructions

In the terrible situation when a loved one is lost as a result of a railroad company’s negligence; the survivors have the right seek compensation for this loss through a lawsuit. Our team helps many victims of serious personal injury and wrongful death.

We will thoroughly investigate your case and lay out every possible course of action for you to consider. At the Law Offices of Craig Goldenfarb, P.A., we understand your legal rights and are determined to get you the maximum amount of compensation possible, so you can recover from your loss and move forward as soon as possible.

Liability & Damage Recovery

It is the responsibility of any railroad company to provide a reasonably safe environment, so that they do not endanger passengers or employees. If that duty is ignored, people can be harmed due to the negligent conduct of the railroad. The railroad is then liable for bodily injuries or deaths that take place as a result of their negligence.

If you have been hurt or lost a loved one in a railroad accident, the Law Offices of Craig Goldenfarb, P.A. may be able to help you get the compensation that you are entitled to. Railroad accident compensation may include:

  • Hospital & Medical Bills
  • Lost Wages
  • Vehicle Damage
  • Pain and Suffering
  • Cost of Future Care
  • Property Damage

Never wait on an insurance agent to make you an offer. Insurance agents and adjusters work for the insurance company and are not concerned with what is best for their injured clients. It is critical that you never agree to or accept a settlement offer from an insurance company without first speaking with an experienced aviation disaster personal injury attorney.

7 Steps To Take
Following a Car Accident

Step 1: Stay on the Scene

Leaving the scene of an accident you are involved in, especially if some has been injured or even killed, is a criminal offense. Doing so could result in significant criminal charges and even jail time.

It is always best to wait for the appropriate time to leave, which will be indicated by a present law enforcement officer.

Step 2: Check on Everyone

First make sure that you are OK, and that you have not sustained any injuries. Some of your own injuries may not be immediately apparent, so be cautious before rushing to the aid of another.

If anyone on the scene needs emergency medical attention, contact an ambulance immediately.

If anyone is unconscious or in severe pain, do not move them unless they are in eminent danger, otherwise wait until qualified medical professionals arrive.

Step 3: Call the Police

The police deal with auto accidents frequently. Having a law enforcement authority on the scene will allow you to have an official police report filed detailing the occurrence, and ensure that the appropriate information has been exchanged.

Do not move your vehicles so that when the police arrive, the scene can be reported as accurately as possible.

Step 4: Gather Evidence

It is important to be as prepared as possible even in situations that seem less significant.

Don’t simply rely on the police report, but gather all the information necessary from drivers, which will include:

  • Full Name
  • Phone Number
  • Address
  • Drivers’ License Number
  • Vehicle Registration Information
  • License Plate Number
  • Insurance Information
  • Take Pictures!

If there are any passengers or witness, collect their names, phone numbers and addresses also. Makes sure to take pictures, and if possible draw a small diagram of the accident.

Take pictures of the accident site and of any damages to your vehicle as soon as possible, this helps ensure that you receive the appropriate amount of compensation for vehicle damage and help you recall details that might otherwise later escape your memory.

Step 5: Contact a Lawyer

A major car accident is one of the most terrifying and stressful events that may occur in a person’s life. Besides having to deal with the pain of your injuries, there are other considerations, such as the damage to your vehicle and working with the insurance company that can become a headache for you to experience.

Contact an experienced attorney like the Law Offices of Craig Goldenfarb, P.A. to represent you if you suffer a personal injury in an auto accident. A skilled attorney will be dedicated to serving your interests and can assist you in recovering financial compensation and additional aid for future expenses resulting from your injury.

Step 6: Get Medical Treatment

Sometimes due to the rush of adrenaline as a consequence of the car accident, your injuries may not be immediately apparent, as you may have sustained internal injuries that reveal themselves several days after the auto accident.

Make sure to see a doctor as soon as possible, even if you don’t have insurance, and keep a detailed account of medical expenses which could bolster your case. You may be entitled to compensation for such expenses.

Our attorney team at Law Offices of Craig Goldenfarb, P.A. will actually guide you through this process, so that you get the appropriate treatment for your needs.

Step 7: Be Extra Cautious!

DO NOT admit fault or claim liability to anyone on the accident scene.

DO examine your surroundings, be vigilant or additional dangers, and document the scene to the best of your ability.

DO NOT call a “lawyer referral service” for help;

DO hire a lawyer who can refer you to medical treatment within 14 days of the accident.

DO NOT allow anyone to solicit you after an accident, either by phone or in person, to either hire an attorney or visit a clinic;

DO report the incident to the Division of Insurance Fraud at 1-800-378-0445. You may be entitled to a reward for the successful prosecution of solicitor crimes.

DO NOT sign anything you are uncomfortable signing nor agree to an insurance settlement prematurely;

DO ask any lawyer you are considering to hire for a free consultation.
